1. Acceptation des conditions

By downloading, installing, accessing, or using Textora ("the App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Textora ("we," "our," or "us").

If you do not agree to these Terms, do not download, install, or use the App.

These Terms apply to all users of the App, including users of the free version and subscribers to paid plans.

Textora is an AI-powered text scanning mobile application that provides:

• OCR Text Extraction: Scans and extracts text from photos using advanced optical character recognition technology
• AI-Powered Categorization: Intelligently categorizes and organizes extracted text
• Card Storage: Saves scanned cards, screenshots, and documents locally on your device
• Cloud Backup: Optional synchronization with your personal cloud storage (iCloud/Google Drive)
• Reminders: Set reminders for saved items
• Export Features: Export scanned text in various formats

All text recognition processing occurs on your device using on-device AI to protect your privacy.

3. Éligibilité

To use Textora, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• If you are between 13 and 18 years old (or the age of majority in your jurisdiction), have permission from a parent or legal guardian
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable laws

4. Comptes utilisateur

Some features of Textora may require you to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent or illegal activities.

5. Abonnements et paiements

5.1 Subscription Tiers

Textora offers the following subscription options:

5.2 Billing and Payment

• All payments are processed through the Apple App Store (iOS)
• Subscription fees are charged to your Apple ID
• Prices are displayed in your local currency and include applicable taxes
• Payment will be charged at the confirmation of purchase

5.4 How to Cancel Your Subscription

You may cancel your subscription at any time. To cancel:

5.5 Refunds

Refunds are handled according to the policies of Apple App Store:

5.6 Price Changes

We may change subscription prices from time to time. If we change prices, we will notify you in advance through the App or via email. Price changes will take effect at the start of the next subscription period following the date of the price change. Your continued use of the paid subscription after the price change constitutes your agreement to pay the new price.

5.7 Free Trials

We may offer free trial periods for paid subscriptions. Unless you cancel before the end of the trial period, you will be automatically charged for the subscription. Only one free trial per user/device.

6. Contenu et responsabilités des utilisateurs

6.1 Your Content

You retain all ownership rights to the content you scan, create, or store using Textora ("User Content"). We do not claim any ownership rights over your User Content.

6.2 User Responsibilities

You are responsible for:

• Ensuring you have the right to scan and store any content (e.g., copyrighted materials, confidential documents)
• Obtaining necessary permissions before scanning content belonging to others
• Backing up your important data
• Using the App in compliance with all applicable laws

6.3 Prohibited Content

You agree not to use Textora to scan, store, or process:

• Content that violates any applicable law or regulation
• Content that infringes on intellectual property rights of others
• Content involving illegal activities
• Malicious content or content designed to harm others

7. Propriété intellectuelle

7.1 Our Intellectual Property

Textora and its original content, features, functionality, and design are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

This includes, but is not limited to:

• The Textora name, logo, and branding
• The App's user interface and design
• The underlying software and technology
• All documentation and related materials

7.2 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal devices
• Use the App for your personal, non-commercial purposes

8. Utilisations interdites

You agree NOT to:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or disassemble the App
• Attempt to extract the source code of the App
• Use the App for any illegal purpose
• Interfere with or disrupt the App's functionality
• Use automated systems, bots, or scripts to access the App
• Circumvent any security features or access controls
• Impersonate any person or entity
• Use the App to transmit malware or harmful code
• Violate any applicable local, state, national, or international law

9. Limitation de responsabilité

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• Textora and its developers, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• This includes, but is not limited to, loss of profits, data, use, goodwill, or other intangible losses
• Our total liability shall not exceed the amount you paid to us in the twelve (12) months prior to the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

10. Exclusion de garanties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

We specifically disclaim:

• Any warranty that the text recognition will be 100% accurate
• Any warranty that the App will be error-free or uninterrupted
• Any warranty regarding the security of your data (though we take reasonable measures)
• Any implied warranties of merchantability, fitness for a particular purpose, and non-infringement

OCR technology, while advanced, may not perfectly recognize all text. You should verify important information extracted by the App.

11. Résiliation

11.1 Termination by You

You may stop using the App and delete it from your devices at any time. If you have a subscription, remember to cancel it to avoid future charges.

11.2 Termination by Us

We may suspend or terminate your access to the App immediately, without prior notice, if:

• You breach these Terms
• You engage in fraudulent or illegal activities
• We are required to do so by law
• We discontinue the App (with reasonable notice)

11.3 Effect of Termination

Upon termination, your right to use the App will immediately cease. Data stored locally on your device will remain unless you delete it. We are not obligated to retain or provide access to your data after termination.

12. Droit applicable et règlement des litiges

These Terms shall be governed by and construed in accordance with the laws of Azerbaijan, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Informal Resolution: We encourage you to contact us first to resolve any disputes informally
2. Arbitration: If informal resolution fails, disputes may be resolved through binding arbitration
3. Small Claims Court: Either party may bring claims in small claims court if eligible

13. Modifications des conditions

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of this page
• For material changes, we will notify you through the App or via email
• Your continued use of the App after changes constitutes acceptance of the new Terms
• If you do not agree to the modified Terms, you should stop using the App

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Textora regarding the App.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
